Terms of Service

By accessing or using Voltiq, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you do not agree to these terms, you may not use the service.

These terms apply to all users of the platform, including visitors, free trial users, and paying subscribers. Your continued use of Voltiq after any revision to these terms constitutes acceptance of the updated version.

You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately at support@tryvoltiq.com.

You may not share account access with others or create multiple accounts to circumvent usage limits. Each account is issued to a single user or business entity.

You agree to provide accurate information when creating your account and to keep it current. Accounts created with false information may be suspended without notice.

We grant you a limited, non-exclusive, non-transferable license to access and use Voltiq for your own internal business analysis and operations.

You may not:

• ▶Resell, sublicense, or share platform access with third parties for commercial gain.
• ▶Reverse engineer, decompile, or attempt to extract our source code or proprietary algorithms.
• ▶Use automated tools, bots, or scripts to scrape, crawl, or stress-test our systems without prior written permission.
• ▶Upload or process data that belongs to a third party without their authorization.
• ▶Use the service in violation of any applicable law, regulation, or third-party right.
• ▶Attempt to gain unauthorized access to other user accounts or to our infrastructure.
• ▶Use the service to transmit spam, malware, or content designed to harm or deceive others.

We reserve the right to investigate and take action against any use of the service that we determine, in our sole discretion, violates these restrictions.

You own your data. All business data, transaction records, and files you upload to Voltiq remain your property at all times.

By uploading data to the platform, you grant Voltiq a limited, non-exclusive license to store and process it for the sole purpose of providing the service to you. We will not use your data to train AI models, sell it to third parties, or share it outside the scope of service delivery.

You are responsible for ensuring that:

• ▶The data you upload is legally yours to share.
• ▶Uploading it does not violate any applicable law, including privacy laws.
• ▶Uploading it does not breach any contractual obligation to your POS provider or other third parties.
• ▶You have obtained any necessary consents from individuals whose information may be included in your exported data.

We are not responsible for any data you upload that violates the rights of a third party. If we receive a valid legal complaint about data you have uploaded, we may remove it and notify you.

Paid plans are billed monthly in advance. By subscribing, you authorize Voltiq to charge your payment method on a recurring basis until you cancel.

Refunds. All fees are non-refundable except as required by applicable law. First-time subscribers who are unsatisfied with the service may request a full refund within 14 days of their initial payment by contacting support@tryvoltiq.com. After 14 days, no refunds will be issued for partial billing periods.

Price changes. We may update our pricing at any time. We will give you at least 30 days notice by email before any price increase takes effect. If you cancel before the new pricing applies to your account, you will not be charged the higher rate.

Founding member rates. If you subscribed under a founding member promotional rate, that rate is locked for the duration of your continuous active subscription under the applicable promotional terms. Canceling and resubscribing, downgrading to a free tier and upgrading again, or any other break in continuous paid service forfeits the founding rate. The standard rate at the time of resubscription will apply.

Failed payments. If a scheduled payment fails, we will attempt to charge your payment method on file up to three times over 7 days. If payment is not collected, access to paid features may be suspended until the outstanding balance is resolved.

Voltiq uses Anthropic's Claude AI to convert your business metrics into written insights. All quantitative analysis, including data parsing and metric calculation, is performed by Voltiq's own systems. Only computed summary numbers are sent to Anthropic's API. Raw transaction records and personally identifiable information are never transmitted to Anthropic or any other external AI provider.

The insights generated through this process are for informational purposes only. They do not constitute financial, accounting, legal, or professional business advice. The accuracy of any insight depends entirely on the completeness and accuracy of the data you provide.

You are solely responsible for any business decisions you make based on information provided by Voltiq. We recommend consulting qualified professionals before making significant financial, operational, or legal decisions.

Voltiq, its technology, design, trademarks, and all platform content are owned by Voltiq and protected by applicable intellectual property laws. Nothing in these terms transfers ownership of our intellectual property to you.

The analysis outputs, insights, and reports generated from your data belong to you. We do not claim ownership of content derived specifically from your uploaded business data.

If you believe that content on the Voltiq platform infringes your intellectual property rights, contact us at support@tryvoltiq.com with a description of the alleged infringement and your contact information.

Voltiq provides the service on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• ▶The service will be uninterrupted, error-free, or available at all times.
• ▶Errors in the service will be corrected within a specific timeframe.
• ▶Any insight or recommendation will be accurate or achieve a specific business result.
• ▶The service will meet your particular business requirements.

The business insights generated by Voltiq reflect the data you provide. If your data is incomplete, stale, or not representative of actual operations, the insights will reflect those limitations. You are responsible for verifying the accuracy of your input data before acting on any output.

To the fullest extent permitted by applicable law, Voltiq and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, even if we were advised of the possibility of such damages. This includes but is not limited to lost profits, lost revenue, loss of data, or business interruption.

Our total cumulative liability to you for any claim arising from or related to these terms or the service is limited to the greater of (a) the total amount you paid to Voltiq in the 12 months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars ($100). Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by local law.

You agree to indemnify, defend, and hold harmless Voltiq and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) that arise from: (a) your use of the service; (b) your violation of these terms; (c) your violation of any law or third-party right; or (d) data you upload that infringes on a third party's rights. Voltiq reserves the right to assume exclusive defense of any matter subject to indemnification at our expense, and you agree to cooperate with that defense.

By you. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You retain access to your account through the end of the period you paid for.

By us. We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these terms, engage in fraudulent activity, cause legal exposure for Voltiq, or otherwise harm other users or the integrity of the platform. In cases of termination for cause, no refund will be issued.

After termination. Following cancellation or termination, your data remains accessible for 30 days so you can export anything you need. After that period, your uploaded files and analysis results are permanently deleted. Account information and billing records are retained for 7 years as required by applicable financial regulations.

If you provide your phone number and give express written consent to receive text messages from Voltiq, we may send you service notifications, billing alerts, product updates, or promotional messages by SMS.

Message frequency varies. Standard message and data rates may apply depending on your mobile carrier and plan.

You can opt out at any time by replying STOP to any text message from us. For assistance, reply HELP or contact us at support@tryvoltiq.com.

Consent to receive SMS messages is not a condition of purchasing or using any Voltiq service. We will never send text messages to any number without prior express written consent.

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action not subject to arbitration will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

Informal resolution first. Before filing any legal claim, you agree to contact us at support@tryvoltiq.com and give us 30 days to try to resolve the issue. Most concerns can be handled quickly this way.

Binding arbitration. If informal resolution fails, the dispute will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org. Arbitration will take place in Delaware, or by video conference if both parties agree. The arbitrator's decision will be final and binding, and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. You agree that any dispute must be brought individually. You waive any right to participate in a class action, class arbitration, or any other representative proceeding against Voltiq.

Exceptions. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to protect intellectual property or prevent irreparable harm. Claims that otherwise qualify for small claims court are also exempt from arbitration.

We may update these terms from time to time. We will notify you by email at least 30 days before any material changes take effect. Minor clarifications may be made without prior notice.

Your continued use of Voltiq after any revision takes effect constitutes acceptance of the updated terms. If you disagree with revised terms, you may cancel your account before they take effect. The "Last updated" date at the top of this page always reflects the current version.
